THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT/TRANSIT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This items supports the Board's Vision of an "Efficient and Accessible Regional Intermodal Transportation Network" and Goal No. 2 to "Enhance our efficient, safe, clean, attractive, and interconnected multi-modal transportation systems."
The Office of Economic and Small Business Development reviewed the scope of work and determined that this project will not contain goals for disadvantaged business enterprises. The purchase of buses with federal funding is exempt from the disadvantaged business enterprise goal setting program by the United States Department of Transportation (Exhibit 2).
The purpose of this contract is to procure a maximum potential of 15 40-foot diesel powered buses and five 40-foot diesel electric hybrid buses, similar to image depicted, for the Transit Division to replace buses which will have operated beyond their useful life and are eligible for replacement (Exhibit 4).
The optional items in this contract cover spare parts, training and manuals. At this time the using agency cannot specify exactly which items, how many, and when the items may be purchased, and have thus included the estimated purchasing amount into the total potential contract amount. Orders will be placed to meet the operational needs of the Division, based on the availability of funds.
NABI Bus, LLC offered a voluntary price reduction for the initial one-year term on optional items for Group 1 in the amount of $63,384 and for Group 2 in the amount of $291,141. For the optional renewal term, including optional items, NABI Bus, LLC offered a voluntary price reduction on optional items for Group 1 in the amount of $64,428 and for Group 2 $101,672.04. The Broward County Procurement Code, Section 21.30.f.2(c) allows for a voluntary price reduction of the price bid by the otherwise low bidder if the reduction does not result in the modification or deletion of any condition of the bid.
This procurement carries a 30% performance and payment guaranty. The Purchasing Division has confirmed with the surety that NABI Bus, LLC has the capacity to obtain the required guaranty.
The amounts referenced in this agenda item have been rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
The Transit Division has reviewed the bid submitted by NABI Bus, LLC and concurs with the recommendation for award (Exhibit 3). Six performance evaluations have been completed for NABI Bus, LLC; the firm has an overall rating of 3.38 out of a possible rating of 5.0. Copies of the vendor performance evaluations are available upon request.
The Director of Purchasing has determined NABI Bus, LLC to be non-responsive to Group 3 based upon the bidder not meeting the specification requirements for the front door of the 60-foot articulated bus.
A previous Contract No. V0732902B1 was for a similar purchase with North American Bus Industries, Inc. for 40-foot diesel powered buses and 40-foot diesel/electric hybrid buses. Prices have been determined to be fair and reasonable based on the Independent Cost Estimate and Producer Price Index.
There was no protest or appeal filed regarding this procurement.
