PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The County purchased property at 3601 Southwest 62nd Way in Miramar, Property ID No. 514125010630, in 2015 as an addition to Snake Warrior’s Island. Archeological and Historical Conservancy completed an archeological assessment of the property the same year. The assessment determined that a historical grave was along the boundary of the property, partially within the right-of-way. The assessment and personal communications with the archeologists recommend fencing the historical grave site into the park. Park operations and administration agree that this is the best course of action. The City conceptually agreed to allow this encroachment into the right-of-way. The location was marked by the archeologists in the field and surveyed by County surveyors. City Attorney and staff drafted the Revocable License Agreement, which was reviewed by the Office of the County Attorney.
The total encroachment will be five feet into the City's right-of-way for a distance of 25 feet parallel with the right-of-way. The County will not use the encroachment area for any other purpose without written consent from the City. This license is an annual revocable license that automatically renews each year unless terminated.
