A request has been filed to amend and partially release the Declaration of Restrictive Covenants recorded in Official Records Book 44460, Page 1653 made in conjunction with Land Use Plan Amendment PC 06-30. The Restrictive Covenant obligates the owner to dedicate land to the City of Tamarac for a future fire station on Tract H of Sabal Palms by Prestige plat (Exhibit 1). The 1.8-acre property is located at the northeast corner of Rock Island Road and Commercial Boulevard (Exhibit 2).
On December 12, 2007, the Board adopted PC 06-30 to change the Land Use Plan designation from Commercial Recreation to Low (5) Residential. The property owner voluntarily entered into this Restrictive Covenant. Section 4(b) of the Restrictive Covenant obligated the owner to convey Tract H to the City for a future fire station. This commitment was made at the request of the City and was not proffered to meet or mitigate a Broward County Land Use Plan policy (Exhibit 3). Recently, Fire Station No. 78, located ¾-mile east of Tract H, underwent renovations. As a result, the City has determined that construction of a new fire station on the Tract H site is no longer needed. |
