THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action will amend a Work Authorization ("WA") to provide funding for continued CPM services for the T4 Gate Replacement Project - Western and Eastern Expansions at FLL.
This item supports the Board's Value for "Ensuring economic opportunities for all people and businesses in Broward County," its Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs" and its Objective to increase passenger facilities in T4 at Broward County's FLL.
The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) goal of 25% for this project. Turner Construction Company ("Turner") committed to 28.20% CBE participation. To date, Turner has been paid $45,140,954 and has paid CBE firms $16,500,091 for a 36.55% participation (Exhibit 2).
On February 14, 2012 (Item No. 35), the Board approved the deliberately phased WA No. WA001TC, in accordance with the CPM Library Agreement between Broward County and Turner for CPM services for the T4 Gate Replacement Project; Western portion (“T4W”), in the amount of $25,175,738, with a time period commencing upon Board approval and ending upon completion of all warranty periods for the project.
On October 1, 2013 (Item No. 2), the Board approved the First Amendment to the deliberately phased WA No. WA001TC between Broward County and Turner for CPM services for the T4 Gate Replacement Project, to add the Eastern Expansion (“T4E”), in the amount of $21,395,192, for a revised total WA amount of $46,570,930, with a time period commencing upon Board approval and ending upon completion of all warranty periods for the project.
On June 13, 2017 (Item No. 2), the Board approved the Second Amendment to the deliberately phased WA No. WA001TC for continued CPM services for the T4 Gate Replacement Project – Western and Eastern Expansions, in the amount of $9,703,856, for a revised total Work Authorization amount of $56,274,786.
Currently, Turner provides CPM services for the T4W and T4E Expansion projects, including construction of the Apron expansion, the Terminal Connector between Terminals 3 and 4, the Checked Baggage Inspection System project, and the Federal Inspection Services facility renovation and expansion projects.
The remaining construction for the FIS facility expansion was publicly solicited in May 2018, with the delegated award approved by the Board June 5, 2018 (Item No. 31, Motion A), and executed by the Director of Purchasing on August 13, 2018. Final construction for all projects is anticipated to be complete in late 2019. Continued CPM services are needed through the projects’ warranty period, which is anticipated to end in late 2020. Turner will continue to manage the associated construction contracts and provide field quality acceptance testing, field verification services, threshold inspections and commissioning services for these projects.
The proposed Third Amendment to the WA will provide funding for continued CPM services to allow for completion of the work and closeout of the projects through the projects’ warranty period. Approval of the proposed Third Amendment increases the Professional Services lump sum in the amount of $250,000, increases the Professional Services maximum not-to-exceed in the amount of $4,656,437, and increases the Reimbursable Expenses maximum not-to-exceed in the amount of $800,000, for a total Third Amendment amount of $5,706,437, increasing the total WA amount from $56,274,786 to $61,981,223.
The proposed Third Amendment to the WA also provides updated contract Exhibits B, C, L, M and N. Exhibit L reflects the current Salary Costs for NV5, Inc., Asset Builders LLC, DeRose Design Consultants, Inc., Keith and Associates, Inc., and Turner, updated in accordance with the Agreement, Article 6.
The proposed Third Amendment to the WA has been reviewed and approved as to form by the Office of the County Attorney.
