THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action provides notice to the Board relative to a Grant Agreement executed by the County Administrator to accept FAA grant funding.
Since 2010, the FAA has offered and Broward County has accepted grant funding in support of the Noise Mitigation Program for Broward County's Fort Lauderdale-Hollywood International Airport. On November 9, 2010 (Item No. 4), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-064-2010, for the Pilot Project and Phase I implementation of the Noise Mitigation Program, in the amount of $8,240,000.
On September 27, 2011 (Item No. 47), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-067-2011, for the Phase II implementation of the Noise Mitigation Program in the amount of $20,000,000.
On September 12, 2012 (Item No. 3), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-069-2012, for the Phase III implementation of the Noise Mitigation Program in the amount of $20,000,000.
On August 11, 2015 (Item No. 66), the Board approved a Note for the Record for Amendment No. 1 to FAA Grant Agreement 3-12-0025-067-2011 changing the grant description to implement a program associated with the extension of Runway 10R-28L, to include the number of dwelling units affected.
On October 6, 2015 (Item No. 2), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-076-2015, for the Phase IV implementation of the Noise Mitigation Program and the Sales Assistance/Conveyance and Release Programs in the amount of $20,000,000.
On September 15, 2016 (Item No. 5), the Board approved a Note for the Record for the execution of FAA Grant Agreement 3-12-0025-067-2011 allowing the County to accept grant funding in the amount of $737,130 to facilitate the closing of the grant, and amending Agreement language to reflect the reallocation of dwelling units affected as per the cost allocation plan dated June 15, 2015 as updated on August 10, 2016.
On September 26, 2017 (Item No. 2), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-082-2017, for the Phase V implementation of the Noise Mitigation Program and the Sales Assistance/Conveyance and Release Programs in the amount of $21,954,209.
As done previously, on September 4, 2018, the FAA notified the Broward County Aviation Department ("BCAD") of a pending Grant Agreement that would be issued after a congressional announcement was made on September 14, 2018. The Grant Agreement would be sent to BCAD overnight after the announcement with a planned delivery on September 17, 2018. The FAA requires immediate acceptance and execution of the Grant Agreement no later than September 18, 2018 (Exhibit 1). BCAD coordinated with Broward County's Grants Office to have the Grant Agreement executed by the County Administrator prior to the FAA deadline of September 18, 2018. This action is to advise the Board of the Grant Agreement's execution by the County Administrator prior to the September 25, 2018, Board meeting.
Because the Grant Agreement document or grant funding amount were not received by BCAD prior to the deadline for the submission of this action, the funding amount and the grant document will be sent to the Board as additional information. Funding for Grant No. 3-12-0025-085-2018 is estimated to represent 80% of the eligible costs to implement Phase V of the Noise Mitigation Program and the Sales Assistance/Conveyance and Release Programs. This FAA Grant requires a County Match of 20% of eligible costs, which is budgeted in the Aviation Department’s Fund 40450.
The Grant Agreement will be reviewed by the Office of the County Attorney prior to the County Administrator's execution. However, the Grant Agreement does not include the County’s standard agreement provisions because the FAA requires the County to execute its standard FAA Grant Agreement.
