THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT, THE RISK MANAGEMENT DIVISION, AND THE OFFICE OF THE COUNTY ATTORNEY RECOMMEND APPROVAL OF THE ABOVE MOTION.
On May 5, 2009, the claimant, a former bus operator, sustained an injury during the course and scope of employment with the Broward County Transit Division. The claimant alleged an injury to the lower back caused while stepping off the bus to check for transmission leakage. Due to the injury suffered from this accident, the claimant was separated from County employment on February 28, 2017.
Through negotiations with the Claimant, a settlement was reached in the total amount of $358,000. This amount is broken down as follows: (1) the Claimant will receive $91,896, which includes $500 for a Release and Resignation Agreement; (2) $198,000 of this settlement is allocated to the purchase of an annuity that will fund future medical costs related to the work accident. This is a requirement as set forth by Medicare; and (3) the Claimant’s attorney will receive $63,240 for fees and $4,864 for costs. The settlement is for all future indemnity and medical benefits. |
