THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action provides notice to the Board relative to a Grant Agreement executed by the County Administrator to accept Federal Aviation Administration ("FAA") grant funding.
On November 9, 2010 (Item No. 4), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-064-2010, for the Pilot Project and Phase I implementation of the Noise Mitigation Program, in the amount of $8,240,000.
On September 27, 2011 (Item No. 47), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-067-2011, for the Phase II implementation of the Noise Mitigation Program in the amount of $20,000,000.
On September 12, 2012 (Item No. 3), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-069-2012, for the Phase III implementation of the Noise Mitigation Program in the amount of $20,000,000.
On August 11, 2015 (Item No. 66), the Board approved a Note for the Record for Amendment No. 1 to FAA Grant Agreement 3-12-0025-067-2011 changing the grant description to implement a program associated with the extension of Runway 10R-28L, to include the number of dwelling units affected.
On October 6, 2015 (Item No. 2), the Board approved a Note for the Record acknowledging execution of an FAA Grant Agreement 3-12-0025-076-2015, for the implementation of the Noise Mitigation Program and the Sales Assistance/Conveyance and Release Programs in the amount of $20,000,000.
On September 15, 2016 (Item No. 5), the Board approved a Note for the Record for the execution of FAA Grant Agreement 3-12-0025-067-2011 allowing the County to accept grant funding in the amount of $737,130 to facilitate the closing of the grant, and amending Agreement language to reflect the reallocation of dwelling units affected as per the cost allocation plan dated June 15, 2015 as updated on August 10, 2016.
On September 19, 2017, the FAA notified the Broward County Aviation Department ("BCAD") of available grant funds which require immediate acceptance and execution no later than September 26, 2017. BCAD coordinated with the Grants Office to have the agreement executed by the County Administrator prior to the FAA deadline of September 26, 2017. This action is to advise the Board of the agreement's execution by the County Administrator.
This FAA Grant No. 3-12-0025-082-2017 in the amount of $21,954,209 represents 80% of the eligible costs to implement Phase V of the Noise Mitigation Program and the Sales Assistance/Conveyance and Release Programs. This FAA Grant requires a County Match of $5,488,552 or 20% of eligible costs, which is budgeted in the Aviation Department’s Fund 40450.
The Agreement was reviewed by the Office of the County Attorney. However, the Grant Agreement does not include the County’s standard agreement provisions because the FAA requires the County to execute its standard FAA Grant Agreement.
