B. MOTION TO AUTHORIZE Director of Purchasing to negotiate, approve and execute the System and Services Agreement between Broward County and Radio One Communications Service Company (Radio One) for Hardware, Software License and Support Agreement to successfully complete and upgrade the MOTOTURBO Connect Plus Local Government Radio System in the estimated amount of $464,341, plus $475,659 for optional services and subscriber units over multiple Fiscal Years, for a total estimated not to exceed contract amount of $940,000. The initial term of the agreement will begin on the date of execution and will terminate two years from the date of final acceptance; and approve and authorize the Director of Purchasing to renew the agreement for two additional one-year terms.

Why Action is Necessary
A. In accordance with the Broward County Procurement Code, Section 21.34, a sole source procurement above the award authority of the Director of Purchasing must be approved and awarded by the Board after solicitation of offers in any manner deemed to be in the best interest of the County by the Director of Purchasing.

B. In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000 per annum or $400,000 in a multi-year period.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

This item supports the Board's vision of "Consistently delivering responsive, efficient, quality services to the public and internal customers" and the goal to "Build into every process and service effective checks and balances that do not cause inefficiency, but rather ensure consistency, continuity, and quality."

On September 23, 2014 (Item No. 32), the Board approved the Agreement between Broward County and Control Communications, Inc. (Control) to engineer, furnish, install and maintain the County’s Local Government radio system consisting of a UHF 400 MHz digital trunking radio system (radio system) resulting from Requests for Proposals (RFP) No. R1147317P1, for the Office of Regional Communications and Technology (ORCAT) for an initial term of ten years at a cost of $3,690,000; and authorize the Director of Purchasing to renew the agreement for an additional one-year period at a cost of $40,000, plus optional services in an estimated amount of $1,000,000 for the potential eleven-year not-to-exceed amount of $4,730,000, which included purchases for other County agencies over multiple Fiscal Years.

The local government radio system is a cost effective solution that will reduce radio traffic overload in the County’s existing Public Safety 800 MHz radio system.

On June 15, 2016, ORCAT sent correspondence to Control indicating all the issues that were not complied with based on the agreement specifications. On June 24, 2016, Control Communications filed for bankruptcy. On July 14, 2016, Control replied to the Partial Rejection Letter disagreeing with all the issues. Following these events, Motorola removed Control Communications' Channel Partner Status deeming Control as unauthorized to install, repair or resell Motorola commercial UHF 400 MHz systems.

Due to the chain of events, the County Attorney’s Office’s bankruptcy attorney recommended that Broward County terminate the contract. The Office of Regional Communications and Technology recommended that a firm perform a baseline study of the system to determine the level of effort to complete the system per the original specifications, and from the baseline, establish a scope of work and estimated cost to complete the project with full manufacturer warranty.

To date, Control has been paid a total of $636,939 for the partially accepted Local Government Radio System (LGRS).  All of the equipment that was purchased and installed as part of that LGRS work at the sites, will be utilized and optimized for completion of the project by Radio One. As this system is not functional, the County still utilizes the County’s existing Public Safety 800 MHz radio system (radio system), which directly affects loading capacity of the County radio system. On February 7, 2017, an Only Reasonable Source procurement with Radio One to complete the project with full manufacturer warranty was approved by the Purchasing Division.

Radio One, a Motorola authorized channel partner, was recommended by Motorola Solutions to complete and upgrade the MOTOTRBO Connect Plus LGRS. Radio One has extensive experience in implementing Mototurbo systems much more complicated than that of Broward County, such as Disney World's radio systems, at multiple locations in Florida. On August 3, 2016, the baseline assessment was completed, and a statement of work and estimated cost to complete the project was established. Radio One will successfully complete and upgrade the MOTOTRBO Connect Plus Local Government Radio System by performing the following: frequency coordination, frequency configuration, equipment and software installation, replace controllers since existing controllers are at end of life, system re-optimization, migration of the City of Sunrise from an existing MOTOTRBO Capacity Plus system to an upgraded MOTOTRBO Capacity Max Radio system including testing and coverage validation. Optional services will include the purchase of additional subscriber units (radios) and accessories by the agencies and the addition of a new site in Miramar Fire Station 99.

By authorizing the Director of Purchasing to negotiate and execute the Agreement, the new vendor can start the project expeditiously during the summer recess period avoiding further delays in the completion of the project.
