MOTION TO AUTHORIZE County Administrator to take any and all necessary actions, including execution of contract amendments, budget Resolutions, work authorizations and construction change orders as needed to provide for continued post-construction phase services and for the continuation of the future phases of the project by James A. Cummings, Inc., the Spillis Candela & Partners/Heery/Cartaya Joint Venture and the Weitz Company for the New Broward County Courthouse project while the Board of County Commissioners is not in session. Why Action is Necessary
MOTIONS A-C: Board of County Commissioners’ approval is required to delegate authority to the County Administrator to enter into agreements with municipalities or other jurisdictional agencies; execute work authorizations and amendments with a dollar value that are in excess of the Purchasing Director's authority;

MOTIONS A-C: Authorizes the County Administrator to take actions as may be deemed necessary for the New Broward County Courthouse project while the Board of County Commissioners is not in session to expedite approvals of various agreements, licenses and other administrative documents as might be required to close permits held by jurisdictional authorities which enables the continuing occupancy of the New Broward County Courthouse and to obtain approvals necessary for the next phases of work in the Broward Judicial Complex; ensures continuity of service by the contractor, design consultant and owner’s construction project manager; work related to the continuing occupancy of the New Broward County Courthouse and expedite authorization of work necessary for the next phases of the Broward Judicial Complex; and expedite vendor agreements associated with post-construction retrofits, non-warranty repairs, and other services related to the operation and future phases of the New Broward County Courthouse project.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL.

This item supports the Board of County Commissioners' Value of “Encouraging investments in renewable energy, sustainable practices and environmental protection" with the goal to "proactively lead in the planning, design and construction of projects to support community resilience and climate adaptation, including coordination with other entities to foster resilient design as part of all local and regional projects".

The New Broward County Courthouse is occupied and is being utilized by the public and tenants. With this occupancy and use, necessary building refinements beneficial to the security, accessibility and usability of the new facility are revealing themselves. Outside the scope of the initial design and construction, these building adjustments may require design input, permits and construction or other service provisions through County-held master agreements or separate procurements. The enabling authority for these actions may rise to a level above that of the Purchasing Director and require Board of County Commissioners’ approval. As many of these actions are also time sensitive, delegation of the Board of County Commissioners’ approval to the County Administrator during the upcoming 2017 summer break will ensure expedient completion of these post-occupancy tasks.

While the operation of the New Courthouse is finalized, work on the 500-car secure parking garage and public plaza, future East Wing renovation and backfilling of space made vacant by occupancy of the new tower continues. As these projects are on-going and time sensitive, various amendments, work authorizations and change orders for the project team may be necessary during the Board of County Commissioners’ 2017 summer break. Delegation of the Board of County Commissioners’ approval to the County Administrator for the break period will help ensure expedient completion of those on-going, time sensitive project tasks.

The proposed Motion A will authorize the County Administrator to execute the agreement(s), license(s) and other administrative documents as may be necessary to obtain permits and other jurisdictional approvals during the Board of County Commissioners’ 2017 summer break. This motion is presented as a contingency measure in order to avoid project delays.

Motion B asks the Board of County Commissioners to delegate signature authority to the County Administrator for amendments, work authorizations, change orders and other documents as may become necessary to expedite services needed for completion of the new courthouse tower and future phases of the project by either the Contractor, the Joint Venture design team, or the Owner’s Construction Project Manager during the Board of County Commissioner's 2017 summer break. This motion is presented as a contingency measure in order to avoid project delays.

Motion C asks the Board of County Commissioners to delegate signature authority to the County Administrator for post-construction retrofits and non-warranty repairs by vendors other than the Contractor, the Joint Venture design team, or the Owner’s Construction Project Manager effecting operations at the new tower as well as any unforeseen work related to the future phases of the project. This motion is presented as a contingency measure in order to avoid project delays.
