Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL.

A request has been filed to amend the Regional Road Concurrency Agreement related to the Duke Pembroke “B” Plat recorded in Official Records Book 46949, Page 917 (Exhibit 1). The plat is located on the east side of I-75 and north of Pembroke Road, in the City of Pembroke Pines on 18.7 acres (Exhibit 2).

On January 26, 2010, the plat was approved with a Regional Road Concurrency Agreement to partially fund the construction of the Pembroke Road bridge over I-75 between Southwest 136 Avenue and Southwest 160 Avenue in the amount of $526,371 with a surety bond.

Currently, this plat is located in the Transportation Concurrency Management Area and transportation concurrency fees will be assessed and paid in accordance with the fee schedule specified in the Land Development Code during the review of construction plans submitted for County environmental review approval. Broward County no longer requires security for the payment of Transit Concurrency Fees. The applicant is requesting to amend the agreement to remove the requirement for a surety bond (Exhibit 3).

This agreement has been approved as to form by the County Attorney’s Office.
