Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL.

A request has been filed for a partial release of the of the Declaration of Restrictive Covenants (DRC) recorded in Official Records Book 32606, Page 1853 made in conjunction with Broward County Land Use Plan “Flexibility Rules” related to affordable housing (Exhibit 1). The subject site, less than one acre, is located on the northeast corner of State Road 7 and Perimeter Road, in the City of Margate (Exhibit 2).

In 2002, Infante II Plat was approved for commercial development and townhouse units. The developer voluntarily restricted a portion of Parcel A and Parcel A-1 to development of “affordable housing for moderate income persons.” Subsequently, Parcel A-2 was sold to HTG Arbor View, LLC. On August 16, 2016, the Board amended the plat note to allow development of 100 age-restricted mid-rise units on Parcel A-2 (not yet recorded). The applicant is requesting Board approval to release a slither of land in Parcel A (identified as the “burdened parcel) from the original DRC so that it can be included in a new DRC for Parcel A-2. The release of the DRC is attached in Exhibit 3.

This release has been approved as to form by the County Attorney’s Office.
