Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION RECOMMEND APPROVAL.

A request has been filed to release the Declaration of Restrictive Covenants (DRC) recorded in Official Records Book 43699, Page 570 made in conjunction with Land Use Plan Amendment PC 06-25 to mitigate student impacts (Exhibit 1). The property is located on the south side of Sheridan Street, between Southwest 172 Avenue and Southwest 166 Avenue, in the City of Pembroke Pines containing approximately 40 acres (Exhibit 2).

On December 12, 2006, the County Commission approved a land use plan amendment that changed the land use designation from Commercial Recreation to Residential Irregular (eight dwelling units per acre). This land use designation allowed 320 townhomes which would generate 88 additional students in the Broward County public school system. The property owner voluntarily entered into a DRC and committed to pay no less than $988,000 for the cost of a modular classroom and to mitigate these impacts.

The owner has complied with the terms of the DRC by making a payment of $1,000,000 to the Broward County School Board. The proposed release was executed by the School Board on February 23, 2017 and has been approved as to form by the County Attorney’s Office (Exhibit 3).
