MOTION TO ADOPT Resolution No. 2017-325 of the Board of County Commissioners of Broward County, Florida, authorizing the Mayor to Execute and File a supplemental Joint Participation Agreement (JPA) with the Florida Department of Transportation (FDOT), District 4, to include FDOT as the lien holder for capital purchases associated with operating the I-75 Express bus service; authorizing the County Administrator or Designee to take necessary administrative actions; and providing for an effective date.

Summary Explanation/Background
THE TRANSPORTATION DEPARTMENT AND TRANSIT DIVISION RECOMMEND APPROVAL.

This item supports the Board’s Values for "Cooperatively Creating an Efficient and Accessible Regional Intermodal Transportation Network".

Interstate 75 (I-75) as part of both the Florida Intrastate Highway System (FIHS) and Strategic Intermodal System (SIS), provides high-speed travel connections between major cities and towns. It is also one of only three north-south major highway systems (I-95 and Florida Turnpike being the others) to carry people and goods into, and out of, South Florida. In order to provide relief from existing and projected traffic congestion along I-75 in Broward County, the Florida Department of Transportation (FDOT) is in the process of making several improvements to I-75 which will include the construction of two reversible express lanes within the median. As part of this improvement project, the Transit Division (BCT) is working closely with FDOT to plan for the provision of future express bus service both during and after construction.  Express bus service is intended to reduce congestion by removing long-distance, single-occupant-vehicle trips from the corridor, thereby improving capacity and mobility for all travelers.

On October 13, 2015 (Item No. 9), the Board approved a Joint Participation Agreement (JPA) to provide $4,090,000 in capital funding for infrastructure associated with operating the future I-75 Express Bus Service, which may include, but not be limited to: buses; park and ride lots and enhancements; signage; shelters and stops; ADA access and pedestrian facilities. FDOT has requested through this Supplemental JPA No. 1 to include language in accordance with their procedure 725-030-025 that any capital purchase in which they participate by more than 50% that the County include FDOT as the only lienholder for said purchase.

The supplemental JPA has been reviewed and approved as to form by the County Attorney’s Office. County approval of the Resolution and execution of supplemental JPA is required prior to FDOT executing said agreement. The term of this agreement is from final execution by FDOT through December 31, 2018.
