MOTION TO APPROVE Second Amendment to Agreement between Broward County and CDM Smith Inc. for Consultant Services for North Regional Wastewater Treatment Pumping System and Septage Receiving Facility Updating, RLI No. Y1099512R1, to provide for deliberately-phased engineering services in the amount of $2,342,596, consisting of $2,192,596 for basic services Tasks 2 through 4, $100,000 for optional additional services, and $50,000 for reimbursable expenses, for a revised potential total of $6,366,650, an increase in time for performance of 620 days; and authorize the Mayor and Clerk to execute same. (Commission Districts 2, 3, 4, 7, 8 and 9)

Why Action is Necessary
Board of County Commissioners’ approval is required for all amendments to contracts exceeding the award authority of the Director of Purchasing in accordance with the Broward County Procurement Code Section 21.94a.

Provides a full-range of consultant engineering services to support the design and construction of various pumping facilities, improvements and construction of the billing meters, and Septage Receiving Facility Operations and Administration Building Improvements.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 13% for this agreement and CDM Smith Inc. has committed to 13% CBE participation. To date, CDM Smith Inc. has achieved 10.37% participation rate (Exhibit 2) while earning 63% of the current contract amount. CDM Smith Inc. indicated that there are still ample opportunities for CBE participation and CDM Smith Inc. remains committed to the 13% CBE participation goal for this contract.

On January 7, 2014 (Item No. 15), the Board of County Commissioners approved the agreement between Broward County and CDM Smith Inc. for Consultant Engineering Services related to North Regional Wastewater Treatment Pumping System and Septage Receiving Facility Updating. The original scope was for design and engineering services during construction for Master Pump Stations 456 and 450, basis of design reports for the Master Pump Stations Controls Upgrade and Wastewater Billing Meters, each with its own design and construction schedule. The original contract value was negotiated as a lump sum and not-to-exceed amount of $2,465,100.

On June 23, 2015 (Item No. 15), the Board of County Commissioners approved the First Amendment to the agreement which included design and engineering services during construction for Master Pump Station Control Upgrades, basis of design reports for Master Pump Station 454 Rehabilitation and Septage Receiving Facility Operations and Administration Building, basis of design reports and design services for Master Pump Station 221 Rehabilitation, design services for Regional Master Meters Improvements and additional design services for Master Pump Station 456 Improvements, each with its own design and construction schedule. The First Amendment contract value was negotiated as a lump sum and not-to-exceed amount of $1,558,954.

This Second Amendment to the agreement provides for design, permitting, bidding and award, submittal analysis, and engineering services during construction for the project as outlined in Exhibit A-2. This amendment includes design services and engineering services during construction for Master Pump Station 454 Rehabilitation, Septage Receiving Facility Operations and Administration Improvements and engineering services during construction for Master Pump Station 221 Rehabilitation and Regional Master Meter Improvements, each with its own design and or construction schedule, with an additional 620 days to ensure that engineering services during construction will be available through the construction period.

One Sunshine meeting was held on December 21, 2016 to negotiate this Second Amendment. The meeting was attended by representatives of CDM Smith Inc., Keith and Associates, Metco Southeast, Inc., and County staff.

This Second Amendment has been reviewed and approved as to form by the Office of the County Attorney and Risk Management Division. All dollar amounts referenced in this agenda item have been rounded to the nearest dollar amount.

The estimated additional project cost is $2,342,596. This amendment will be incrementally funded as Notices to Proceed are issued for different tasks.
