Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL AND CONSUMER PROTECTION DIVISION (ECPD) RECOMMEND APPROVAL OF THIS MOTION.

During the 2017 Florida legislative session, House Bill (HB) 221 (Exhibit 1) was signed by Governor Scott on May 9, 2017. HB 221 preempts local governments from regulating Transportation Network Companies except under limited circumstances related to operation at the airports and seaports. Broward County's Motor Carrier Ordinance (Chapter 22½) must now be revised to ensure compliance with State law.
