MOTION TO DIRECT Office of the County Attorney to draft an Ordinance amending Chapter 5, Building Regulations and Land Use, of the Broward County Code of Ordinances to revise and update provisions pertaining to the Land Development Code to increase efficiency in development application review, improve customer satisfaction, enhance consistency and procedures, and make general housekeeping amendments.

Why Action is Necessary
Section 163.3202(1), Florida Statutes, requires that the Board adopt Land Development Regulations to implement BrowardNEXT within one year. Board action is required to direct the County Attorney to draft an Ordinance amending Chapter 5, Building Regulations and Land Use, of the Broward County Code of Ordinances.

Directs the County Attorney to draft an amendment to the Chapter 5 Article IX "Broward County Land Development Code," of the Broward County Code of Ordinances.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE PLANNING AND DEVELOPMENT MANAGEMENT DIVISION (PDMD) RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board's value of consistently delivering responsive, efficient, quality services to the public and internal customers: Goal 1: Build into every process and service effective checks and balances that do not cause inefficiency, but rather ensure consistency, continuity, and quality.

During BrowardNEXT outreach activities, a number of recommendations were put forward to improve Broward County's land development regulations. Staff will also reach out to the development community and our municipal partners again during the amendment process to identify additional specific changes that might enhance existing regulations. 

Updating the Land Development Code will increase efficiency in development application review and improve customer satisfaction and consistency in procedures. Specifically, PDMD is seeking to update the Code to streamline the platting process; simplify existing development review and notification procedures; delete regulations and processes that are no longer required to implement concurrency; simplify approval of plat amendments where possible; modernize the code to accommodate electronic permit review; and make other changes necessary to implement BrowardNEXT.
