Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On January 21, 2013, a Broward County Transit bus was traveling northbound on State Road 7 approaching Atlantic Boulevard in Pompano Beach, when the Bus Operator allegedly applied the brakes abruptly when a car cut the bus off and stopped suddenly. The Claimant, a passenger on the bus, is alleging injuries to the left shoulder and neck as the result of falling and has incurred $34,753 in medical expenses. The Claimant does have health insurance and a lien in the amount of $6,540 has been placed on the file by the health care carrier. The Claimant had left shoulder open reduction surgery. There is no video.

The Employee Report of Accident or Incident confirms the facts of the loss.

The amounts referenced in this agenda have been rounded to the nearest whole dollar.  A tentative settlement agreement was reached in the amount of $31,000, pending Board approval. The settlement is conditioned on a release of the County from any further obligations.

Please note the Concurrence Memorandum was signed by the Office of the County Attorney on May 5, 2017, which is within the 90-day period between settlement and concurrence, as requested by the Board.
