Requested Action
MOTION TO APPROVE site access license agreement between Broward County and the Florida Department of Environmental Protection (FDEP) to continue ongoing assessment and remediation activities under state funded FDEP petroleum cleanup programs at Port Everglades, for a term of five years effective upon approval; and authorize the Mayor and Clerk to execute same.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

This item supports the Broward County Board of County Commissioners' (Board) Value of "Encouraging investments in renewable energy, sustainable practices and environmental protection" and Goal to "Seek funding for, implement policies and pursue projects promoting, the use of alternative energy, resource conservation, sustainable practices and environmental protection."

FDEP maintains programs to assess, remove, monitor and remediate petroleum contamination on properties eligible under the state funded Petroleum Restoration Program. Port Everglades contains certain County-owned lands which were deemed eligible on July 12, 1990, and have been the subject of a number of different state-funded remediation projects since then. Each of these projects were previously completed under short-term agreements approved by the Port Director. FDEP now requires execution of their standard form Site Access Agreement for participation in continued assessment and remediation activities. The Agreement remains valid until all State-funded remediation activities are completed at Port Everglades.

FDEP will select a contractor from its list of approved Agency Term Contractors (ATC) to perform the on-site activities provided for in the Site Access Agreement. The County will enter into separate one-year site access agreements with the selected ATC(s) under the authority of the Port Director. These agreements will contain provisions for indemnification and insurance.

The License Agreement has been approved by the Port Everglades Risk Manager and approved as to form by the Office of the County Attorney. Agreements with FDEP are executed by the County prior to the State.
