Why Action is Necessary
A. In accordance with Broward County Procurement Code, Section 21.85 and 21.91, Professional Testing Services covered under Section 287.055, Florida Statutes, "Consultants' Competitive Negotiations Act" (CCNA) may be purchased by the establishment of a Rotating List for purchases above or below the mandatory bid amount, and the award must be made by the Board and the contracts signed by the Mayor, Vice Mayor, or individual specifically indicated by the Board.

B. In accordance with the Broward County Procurement Code, Section 21.14.c.6, the Director of Purchasing shall execute all contracts and amendments delegated by the Board for the Director's execution.

A. Approves the Selection Committee's recommendation of the list of qualified firms for inclusion to a rotating list of vendors for future County projects requiring professional engineering testing services.

B. Facilitates the execution of contracts with firms included on the Rotating List for Professional Engineering Testing Services.

Summary Explanation/Background
THE PURCHASING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

The purpose of this solicitation is to engage the services of qualified engineering firms for participation in a rotating list of vendors for professional engineering testing services governed by CCNA and establish prices for required tests and services. The resulting list of vendors will satisfy individual projects' testing requirements without soliciting separate RFQ's, which create project delays.

On June 23, 2015 (Item No. 71), the Board approved the Request for Qualifications (RFQ) No. M1329819R1, Rotating List for Professional Engineering Testing Services. The Purchasing Division initially advertised this solicitation on July 8, 2015. Staff determined that a number of included tests were either outdated or no longer needed and subsequently delayed the opening for a comprehensive revision to the specifications and requirements. After revisions, the Purchasing Division extended the opening date of the solicitation to August 31, 2016. Twelve firm's submitted responses to the RFQ, and one firm subsequently withdrew prior to the committee meeting for qualification.

Between September 2016 and March 2017 delays in processing this procurement were due to the necessary due diligence requirements to thoroughly vet the Proposers and their submittals. There were twelve responses received for this procurement and all twelve Proposers needed to be independently reviewed.

On March 30, 2017, the Purchasing Division held a Qualification Shortlist Meeting and 10 firms were determined to be both responsive and responsible. ECS-Florida, LLC was found non-responsive for failure to comply with the County's Domestic Partnership Act requirements (Exhibit 1).

The Purchasing Division posted the Selection Committee's proposed recommendation of qualification on the Division’s website from April 3, 2017 through April 5, 2017, which provided an opportunity for any respondent or interested party to present any new or additional information regarding the responsibility of the respondents. There was no additional information submitted within this timeframe.

The Purchasing Division posted the Selection Committee's final recommendation of qualification on the Division’s website from April 6, 2017 through April 12, 2017, which provided an opportunity for any aggrieved respondent to file a formal protest. There was no protest filed within this timeframe.

Contract Term: December 2, 2008 through August 31, 2014.  Expenditures to Date: $773,800.70.  Using agencies have been utilizing other consultant and engineering type of contracts in the interim, to allow for implementation of an all encompassing replacement contract.
