MOTION TO ADOPT Resolution No. 2017-302 directing the County Administrator to publish a Notice of Public Hearing to be held on Tuesday, August 15, 2017, at 10:00 a.m. in Room 422 of the Governmental Center to consider adoption of a proposed Resolution amending the Broward County Administrative Code, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT; AMENDING SECTION 40.23 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"); REGARDING THE ENVIRONMENTAL PROTECTION FEES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
Section 3.04(A) of the Broward County Charter requires the posting of notice and a public hearing for adoption of proposed amendments to the County Administrative Code.

This action allows a public hearing date to be set and adequate notice to be published regarding amendment of Environmental Protection and Growth Management Department license fees.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL ENGINEERING AND PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

Staff recommends revisions to the fee schedule to clarify the application of fees based on project types and the applicability of monitoring fees for mitigation projects. Notably, the modifications reduce the fee for the installation of buoys or aids to navigation from $450.00 to $250.00 and limit mitigation fees to mitigation projects monitored under the jurisdiction of Broward County. The proposed revisions are expected to be revenue neutral. The last major fee schedule revision for Section 40.23 of the Administrative Code was in 2007.
