MOTION TO APPROVE Second Amendment to the deliberately phased Work Authorization No. WA001TC, in accordance with the Construction Project Management Library Agreement between Broward County and Turner Construction Company, for continued construction project management services for the Terminal 4 Gate Replacement Project - Western and Eastern Expansions at Broward County’s Fort Lauderdale-Hollywood International Airport, for an increase in the Professional Services Lump Sum amount of $325,000, an increase in the Professional Services Maximum Not-to-Exceed amount of $11,903,856, and a decrease in the Reimbursable Expenses Maximum Not-to-Exceed amount of ($2,525,000), for a total Second Amendment amount of $9,703,856, increasing the total Work Authorization amount from $46,570,930 to $56,274,786; and authorize the Mayor and Clerk to execute same.

Why Action is Necessary
In accordance with Article 5.3 of the Construction Project Management Library Agreement, Broward County Board of County Commissioners ("Board") approval is required when the cumulative total of the amended Work Authorization exceeds the Purchasing Director’s approval authority.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION. 

This item supports the Board's Value for "Ensuring economic opportunities for all people and businesses in Broward County," its Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs" and its Objective to increase passenger facilities in Terminal 4 at Broward County's FLL.

This action amends Work Authorization WA001TC for continued Construction Project Management ("CPM") services for the T4 Gate Replacement Project - Western and Eastern Expansions.

The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) goal of 25% for this project. Turner Construction Company ("Turner") committed to 28.20% CBE participation. To date, Turner has been paid $33,160,674 and has paid CBE firms $11,794,408 for a 35.57% participation.

On December 9, 2008 (Item No. 83), the Board approved Agreements between Broward County and two firms for Request for Letters of Interest No. 20071014-0-AV-01A which established a Library of CPM firms for the Broward County Aviation Department and authorized the Director of Purchasing to execute the remaining Agreements between the remaining short listed vendors and to add or delete vendors as in the best interest of the County.

On May 19, 2009, the Director of Purchasing approved Agreement No. 20071014-0-AV-01A, in accordance with the CPM Library Agreement between Broward County and Turner for Construction Management Services for Various Airport Projects, with a time period commencing upon Director of Purchasing approval and ending upon completion of all warranty periods provided for in the construction contracts for the Project.

On February 14, 2012 (Item No. 35), the Board approved the deliberately phased Work Authorization No. WA001TC, in accordance with the CPM Library Agreement between Broward County and Turner for CPM services for the T4 Gate Replacement Project; Western portion (“T4W”), in the amount of $25,175,738, with a time period commencing upon Board approval and ending upon completion of all warranty periods for the project. The T4W scope only involved the shell space construction for the future Checked Baggage Inspection System ("CBIS").

On October 1, 2013 (Item No. 2), the Board approved the First Amendment to the deliberately phased Work Authorization No. WA001TC between Broward County and Turner for CPM services for the T4 Gate Replacement Project - Eastern Expansion (“T4E”), in the amount of $21,395,192, for a revised total Work Authorization amount of $46,570,930, with a time period commencing upon Board approval and ending upon completion of all warranty periods for the project.

Turner provides CPM services for the T4W and T4E Expansion projects, which includes construction of the Connector Bridge, Apron expansion, Federal Inspection Services (“FIS”) facility renovation and expansion, and CBIS shell space.

On March 15, 2016, (Item No. 31, Motion B), the Board approved funding for Phase 1 and 2A construction to expand the FIS facility (being performed by Cummings Balfour-Beatty, A Joint Venture). The scope for the FIS facility was expanded from an existing facility renovation to include construction of the new North Baggage Hall and Secondary Processing area.

On December 6, 2016, (Item No. 5), the Board approved additional funding to complete the North Baggage Hall with Interim Secondary Processing area. At that time, the Board was advised that the remaining construction consisting of the South Baggage Hall with completion of the final Secondary Processing area, was in the design stage and would be competitively bid.  Design of this remaining construction (Phases 2 B and 3) of the FIS expansion, is in the final stage and a competitive solicitation is anticipated to occur by late 2017, with contract award to follow. Turner CPM services will be required for this project through the warranty period which is estimated for late 2019. In addition, Turner CPM services will be required for the CBIS build-out project through the warranty period which is estimated for early 2020.

As a result, the proposed Second Amendment to the deliberately phased Work Authorization WA001TC will fund continued CPM services through the projects’ warranty periods. Turner will continue to manage the associated construction contracts, providing field quality acceptance testing, field verification services, threshold inspections and commissioning services for these projects.

Approval of the proposed Second Amendment increases the Professional Services Lump Sum amount by $325,000, increases the Professional Services Maximum Not-to-Exceed amount by $11,903,856, and decreases the Reimbursable Expenses Maximum Not-to-Exceed amount by ($2,525,000), for a total Second Amendment amount of $9,703,856, increasing the total Work Authorization amount from $46,570,930 to $56,274,786.

The proposed Second Amendment to Work Authorization WA001TC also provides updated contract Exhibits C2, K2, L2, M2 and N2. Exhibit C2 reflects current Reimbursable Expenses, Exhibit K2 reflects current CBE Subcontractor Participation, Exhibit L2 reflects current Salary Costs for NV5, Inc., Asset Builders LLC, DeRose Design Consultants, Inc., Keith and Associates, Inc., Shiff Construction & Development, Inc., and Turner, which were updated in accordance with the allowable annual adjustment per the Agreement; Article 6, Exhibit M2 reflects current Key and Core Staff, and Exhibit N2 reflects the current Staffing Plan.

Two Sunshine meetings were held on July 29, 2016 and April 3, 2017 to negotiate this proposed Second Amendment. These meetings were attended by BCAD staff, Turner representatives and the Program Management Office representatives.

The amounts referenced in this agenda have been rounded to the nearest whole dollar. Vendor payments will be based on the maximum amount payable under this Work Authorization.

This Work Authorization has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
