Last July, 18 municipalities sued the County seeking to compel the County to distribute solid waste disposal district assets as directed by the Resource Recovery Board ("RRB") at its final meeting in June 2013. The RRB's attempted distribution violated the terms of the applicable interlocal agreement, and would disserve the residents and businesses of Broward County.
The presiding circuit court abated the lawsuit due to the plaintiffs' failure to exhaust the Chapter 164, Florida Statutes, intergovernmental dispute Resolution process prior to filing suit. Since the matter was abated, the parties have engaged in extensive mediation efforts. On June 20, 2014, the municipal plaintiffs declared an impasse in the mediation. The terms of any proposals exchanged during the mediation are confidential and cannot be publicly discussed or disclosed.
This Resolution distributes the relevant assets and liabilities in a manner that is consistent with the interlocal agreement and that best serves and protects the County's residents and businesses. |
