MOTION TO ADOPT Resolution No. 2014-343 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, August, 12, 2014, at 2:00 p.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO AIRPORTS AND AIRCRAFT; AMENDING VARIOUS SECTIONS OF CHAPTER 2 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AMENDING DEFINITIONS; AMENDING PROVISIONS PERTAINING TO OPERATIONS ON THE AIRPORT OPERATIONS, MOVEMENT, AND NONMOVEMENT AREA; AMENDING GENERAL USE RESTRICTIONS AND OPERATIONS PERTAINING TO NORTH PERRY AIRPORT; AMENDING PROVISIONS RELATING TO GROUND TRANSPORTATION AT FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT; AMENDING PROVISIONS RELATING TO AIRPORT TRAFFIC AND PARKING; AMENDING CHAPTER 8½ OF THE CODE PERTAINING TO CIVIL PENALTIES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meeting of May 13, 2014.

Amends sections of Part II, Chapters 2 and 8½ of the Code relating to operations on the Movement and Nonmovement Area, general use restrictions and operations, ground transportation, and Airport traffic and parking at Fort Lauderdale-Hollywood International Airport and North Perry Airport.

On May 13, 2014 (Item No. 2), the Board directed the Office of the County Attorney to draft an Ordinance amending various subsections of Chapters 2 and 8½ of the Broward County Code of Ordinances (Code) to update regulations regarding operations on the Movement and Nonmovement Area at the Fort Lauderdale-Hollywood International Airport (FLL) as well as regulations pertaining to North Perry Airport (HWO), and to amend the schedule of civil penalties.

The Broward County Aviation Department follows regulations pertaining to aircraft operations at FLL and HWO contained in Chapter 2 of the Code. Fines for violations of these regulations are included in Chapter 8½ of the Code. Current procedures as established in subsections of Chapter 2 need updating to reflect present operational requirements at FLL and HWO. Additionally, fines for safety and security violations included in Chapter 8½ need to be updated or added to coincide with the regulations as stated in Chapter 2.

Enactment of the proposed Ordinance will ensure that Chapter 2 is updated, and that Chapter 8½ is consistent with Chapter 2.
