MOTION TO CONSIDER adoption of a Resolution No. 2014-365 Amending the Administrative Code, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO WORKING STANDARDS AT FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT ("AIRPORT"); AMENDING CHAPTER 26 OF THE BROWARD COUNTY ADMINISTRATIVE CODE TO AMEND PART V PERTAINING TO AIRPORT WORKER STANDARDS; PROVIDING FOR DEFINITIONS AND ENSURING UNINTERRUPTED SERVICE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE BROWARD COUNTY ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.
 
ACTION: (T-2:38 PM) Approved with the Purple-Sheeted Additional Material, dated June 24, 2014, submitted at the request of the  County Attorney's Office.  The Board requested that the Aviation Department bring information back to the Board over summer break surrounding the number of contracts that are currently in place that are not paying the Living Wage.  (Refer to minutes for full discussion.)

VOTE: 8-0. Commissioner Gunzburger was not present.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Administrative Code was adopted by the Board of County Commissioners at its meeting of June 10, 2014.

Amends the Broward County Administrative Code in order to implement a provision addressing uninterrupted services at the Fort Lauderdale-Hollywood International Airport ("Airport").

Summary Explanation/Background
On May 13, 2014, the Board directed the Office of the County Attorney to draft a Resolution to address uninterrupted services at the Airport.

Broward County gains significant revenue from the Airport, and the smooth and continuous operation of airport services is essential to the viability and growth of the Airport. Because Broward County has a proprietary interest in ensuring that airport services are not disrupted, requiring Terminal Services permittees to ensure uninterrupted service is a critical issue for Broward County.

The proposed amendments to Chapter 26 of the Broward County Administrative Code require Terminal Services Permits issued pursuant to Section 26.37 to include a requirement that each covered Contractor and Subcontractor demonstrate, in writing, what measures it will take to provide uninterrupted services at the Airport during the term of the Terminal Services Permit. In the event of a cessation or interruption in services because of a work stoppage or other protest by a Contractor's or Subcontractor's employees, the County would have the right to revoke the Terminal Services Permit.
