MOTION TO CONSIDER adoption of a Resolution No. 2014-362 Amending the Administrative Code, the title of which is as follows:
 
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO CHAUFFEUR REGISTRATION; PROVIDING FOR CHANGES IN FEES CHARGED FOR OBTAINING A COMPLETE DRIVING RECORD; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE BROWARD COUNTY ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Administrative Code was adopted by the Board of County Commissioners at its meeting of June 3, 2014.

Summary Explanation/ Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND THE ENVIRONMENTAL LICENSING AND BUILDING PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Environmental Licensing and Building Permitting Division (ELBPD) is required to obtain a complete driving record for the purpose of processing chauffeur registrations pursuant to Chapter 22½ of the Broward County Code of Ordinances.  Complete driving records have historically been obtained free of charge from the Florida Department of Highway Safety and Motor Vehicles (DMV) through its Driver and Vehicle Express (DAVE) system. On May 9, 2014, the DMV notified ELBPD that the County's free and open access to complete driving records through DAVE would be suspended as of May 15, 2014. 
 
The County has a vendor that can provide access to complete driving records at a cost of $20.60 per record. As ELBPD operates on a full-cost recovery basis, the proposed amendment will allow the increased costs imposed by the DMV's actions to be passed on to the chauffeur applicant or alternatively allow the applicant to independently obtain a copy of his or her complete driving record directly from the Clerk of Courts at the applicant's own expense (currently $16.25).  Chauffeur registrations are renewed biennially at a cost of $64, which includes a $24 pass through fee paid to the Florida Department of Law Enforcement for criminal background checks. The additional $20.60 pass through fee would increase the total cost to $84.60. ELBPD is also in the process of investigating whether a Memorandum of Understanding with the DMV would be feasible and if so, all associated costs (currently $10 for a complete driving record) would be collected from the applicant and passed through to the DMV.
