MOTION TO APPROVE Declarations of Restrictive Covenants governing the use of Open Space Site OS-137 located in the City of Cooper City for public park and stormwater management purposes in accordance with the Broward County Safe Parks and Land Preservation Bond Program Restrictions and the Palm Avenue Road Improvement Project; and authorize the Mayor and Clerk to execute same.  (Commission District 5)

Summary Explanation/ Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION AND THE NATURAL RESOURCES PLANNING AND MANAGEMENT DIVISION RECOMMEND APPROVAL
 
This item supports the Board of County Commissioners' Vision for "A Pristine, Healthy Environment" and its Goal No. 2, "Encourage and promote community stewardship and appreciation of the natural environment and the conservation and wise use of our resources."

On September 9, 2008, Item No. 41A, the Board of County Commissioners approved an Interlocal Agreement between Broward County and the City of Cooper City (City) for the acquisition, improvement, enhancement, operation and management of Open Space Site OS-137 and Palm Avenue Water Retention Area. Under the agreement, a 5.98-acre parcel of land was acquired by the County utilizing Broward County Safe Parks and  Land Preservation Bond Funds (3.98 acres) and Highway Construction and Engineering Division's Capital Improvement Project Funds for Palm Avenue (2.0 acres). The agreement also provided for the County's conveyance of the property to the City after which, the City shall properly maintain and manage all improvements therein. Additionally, one of the provisions required declarations of restrictive covenants to be placed on the property prior to its conveyance to the City.    

The Declaration of Restrictive Covenants (Open Space Park) in Exhibit 1 specifies that the property shall be preserved as open space and for recreational use in perpetuity. The Declaration of Restrictive Covenants (Stormwater Management) in Exhibit 2 specifies that the water retention area within the property shall be utilized solely as a stormwater retention pond for drainage and management of stormwater originating from Palm Avenue. The declarations shall become effective upon recordation in the Public Records of Broward County.
