MOTION TO ADOPT Resolution No. 2018-215 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, May 22, 2018, at 10:00 a.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
 
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE SIX-CENT ($0.06) LOCAL OPTION GAS TAX; AMENDING SECTIONS 31½-32, 31½-33, 31½-34, AND 31½-35 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); RELEVYING THE SIX-CENT ($0.06) LOCAL OPTION GAS TAX; PROVIDING FOR THE DURATION OF THE RELEVIED SIX-CENT ($0.06) LOCAL OPTION GAS TAX; ELIMINATING THE REQUIREMENT FOR ANNUAL AMENDMENTS TO THE APPLICABLE INTERLOCAL AGREEMENT; PROVIDING FOR A CERTIFIED COPY TO BE SENT TO THE STATE OF FLORIDA DEPARTMENT OF REVENUE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

ACTION:  (T-12:18 PM)  Approved, as amended, with the Yellow-Sheeted Additional Material, dated May 8, 2018, submitted at the request of the Office of the County Attorney.

Why Action is Necessary
The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meeting of January 23, 2018.
What Action Accomplishes
The proposed Ordinance reestablishes the six-cent ($0.06) local option gas tax and makes it effective on September 1, 2018.

Summary Explanation/Background
Pursuant to Section 336.025, Florida Statutes, the County is authorized to levy, by ordinance, a six-cent ($0.06) local option gas tax to be used for transportation expenditures.  The current tax levy and interlocal agreement with the municipalities will expire on August 31, 2018.  Therefore, the County must reestablish the tax, by ordinance, before July 1, 2018, to be effective on September 1, 2018, through December 1, 2047, both dates inclusive.
 
The County and the municipalities representing a majority of the population of the incorporated area have entered into a new interlocal agreement reestablishing the distribution formula for the proceeds of the six-cent ($0.06) local option gas tax from September 1, 2018, through December 31, 2047.
