Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

Broward County owns two portions of right-of-way located in the Town of Lauderdale-By-The-Sea. The parcel identified by Folio No. 4943-07-00-0420 is approximately 4,311 square feet situated on Coral Reef Drive near South Ocean Drive (aka State Road A1A). Title was conveyed to the County for roadway purposes on December 20, 1963 via warranty deed recorded in Official Record Book 2724, Page 176 of the Public Records of Broward County.

The parcel identified by Folio No. 4943-18-01-4160 is approximately 6,275 square feet situated on Hibiscus Avenue near Bougainvilla Drive. Title was conveyed to the County to construct a public road on August 24, 1942 via a Right-Of-Way Deed recorded in Official Record Book 408, Pages 245-246 of the Public Records of Broward County.

The Town requested both portions of right-of-way be transferred to the Town as they are local roads under the jurisdiction and maintenance of the Town.  On March 27, 2018 the Town Commission of Lauderdale-By-The-Sea approved the acceptance of the parcels pursuant to Florida Statutes, Section 335.0415(3) which states public roads may be transferred between jurisdictions by mutual agreement by the affected governmental entities.

All applicable County agencies were solicited for potential County use for these properties or rights therein, and  no current or future use was identified.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
