Requested Action
A. MOTION TO AWARD fixed contract to low bidder, Concrete Protection and Restoration, Inc., for Observation Tower Repairs, Anne Kolb Nature Center, Bid No. K2114774C1, for the Highway Construction and Engineering Division, in the total amount of $337,975 including an allowance for permits in the amount of $16,000, to be substantially completed within 90 calendar days from the Project Initiation Date listed in the Second Notice to Proceed, contingent upon the receipt and approval of insurance/performance and payment guaranty and authorize the Mayor and Clerk to execute same. (Commission Districts 6 and 7)

B. MOTION TO APPROVE increase of change order allowance by 5%, in addition to the allowable 5% administrative increase, for a total change order allowance of 10% to address unforeseen conditions that may be identified during construction.

Why Action is Necessary
A. In accordance with the Broward County Procurement Code, Section 21.31.a.4, the Board is required to approve all purchases exceeding $250,000.

B. In accordance with the Broward County Procurement Code, Section 21.73.c, the Board is required to approve any change order allowance increase exceeding 5% of the original contract amount. 
What Action Accomplishes
A.  Provides for the furnishing of all labor, equipment, services, materials and incidentals for the Anne Kolb Nature Center Observation Tower Repairs Project.

B.  Provides an additional change order allowance for the contract administrator to approve change orders over the standard 5% allowance to address unforeseen conditions.

Summary Explanation/Background
THE PURCHASING DIVISION, THE PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION,  AND THE PARKS AND RECREATION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 20% for this contract. Concrete Protection and Restoration, Inc. committed to 20.9% CBE participation, which has been reviewed and approved by the OESBD (Exhibit 2).

This contract provides for concrete restoration repairs, railing replacement, and painting of the Anne Kolb Nature Center observation tower. This bid included 24 base bid items and two optional groups (painting and protective sealing) that would be awarded based on available budget and in the best interest of the County. Based on the pricing received, the Highway Construction and Engineering Division and the Parks and Recreation Division determined to award the base bid items and one optional group.

This procurement carries a 100% performance and payment guaranty. The Purchasing Division confirmed with the surety company that Concrete Protection and Restoration, Inc. has the capacity to obtain the required guaranty.

The allowances incorporated into this contract in the amount of $16,000 include: $14,000 for non-Broward County permit fees, and $2,000 for miscellaneous utility, certification and municipality fees. Expenditures under these allowance items must be approved by the contract administrator and will be reimbursed at the contractor’s incurred cost without markup.

Due to the typical incidence of an unforeseen condition to occur during concrete restoration type repairs, an increase to the administrative change order allowance is requested. The requested additional 5% change order allowance above the 5% allowable administrative change order allowance will enable the Highway Construction and Engineering Division to expedite necessary change orders of up to 10% of the original contract amount, without impacting the project completion schedule.

The Highway Construction and Engineering Division reviewed the bid submitted by Concrete Protection and Restoration, Inc. and concurs with the recommendation for award (Exhibit 3). Six vendor performance evaluations were completed for Concrete Protection and Restoration, Inc.; the firm has a rating of 4.41 out of a possible 5.0. Copies of the vendor performance evaluations are available upon request.

The Highway Construction and Engineering Division reviewed the prices submitted by the recommended bidder, Concrete Protection and Restoration, Inc., and determined that prices are fair, reasonable and aligned with market analysis for the industry (Exhibit 4).

There was no protest or appeal filed regarding this procurement.

The bid posted on January 2, 2018, and opened on February 7, 2018; six bids were received with one declination (Exhibit 1).
