MOTION TO APPROVE Declaration of Maintenance Obligation between Broward County and the City of Fort Lauderdale for improvements to City rights-of-way adjacent to the new Broward Addiction Recovery Center (BARC) located at 325 SW 28th Street, Fort Lauderdale subject to final approval by the City of Fort Lauderdale; and authorize the Mayor and Clerk to execute same. Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

As a condition to obtaining the Certificate of Occupancy for the new Broward Addiction Recovery Center, the City of Fort Lauderdale is requiring the County execute the proposed Declaration Regarding Maintenance Obligation. Pursuant to the Approved Development Plan by the City, the County was required to install sidewalks and landscaping in the swale areas of SW 27th Street, SW 28th Street and SW 3rd Avenue. The proposed Declaration sets forth the County's responsibilities which include repairing, replacing and maintaining landscaping and sidewalks and providing insurance. The City's process requires an attorney's opinion of title prior to the City's approval of the Declaration of Maintenance Obligation which has been ordered by County staff. In addition, City has requested minor revisions to the legal description of the site improvement area which the County's consultant is completing. The proposed Declaration of Maintenance Obligation will be executed after City's final review and approval.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
