MOTION TO APPROVE Revocable License Agreement between Broward County, the City of Fort Lauderdale and The Dan Marino Foundation, Inc. for installation of landscaping, irrigation and related improvements along the east side of Andrews Avenue between NE 4 Street and NE 5 Street in the City of Fort Lauderdale, at no cost to the County; effective upon execution; and authorize the Mayor and Clerk to execute same. (Commission District 7)

Summary Explanation/ Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL

Andrews Avenue is a County road within the municipal limits of the City of Fort Lauderdale. The Dan Marino Foundation, Inc. (Foundation) and the City of Fort Lauderdale (City) desire to improve the east side of Andrews Avenue by installing landscaping and irrigation improvements along the Foundation's property between NE 4 Street and NE 5 Street.

This item supports the Board of County Commissioners' adopted Strategic Plan Visions and Goals for 2012-2016: "A Pristine, Healthy Environment." Goal 1: "Promote, protect and enhance the built environment in collaboration with governmental and private partners." 

The proposed revocable license agreement (RLA) will allow the Foundation to install landscaping, irrigation and related improvements within the County right-of-way on Andrews Avenue and will obligate the property owner to maintain these improvements. The landscape improvements will comply with the requirement for minimum 50% native species by plant types and with the Broward County NatureScape Program and Florida-Friendly Landscaping principles. In the event that the Foundation fails to maintain the improvements, the City is obligated to perform the maintenance. The RLA also allows the County to terminate the agreement with or without cause at any time. If the RLA is terminated, the Foundation must remove all improvements within the licensed right-of-way and restore the property.
