MOTION TO CONSIDER enactment of an Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO ENVIRONMENTAL LICENSING; AMENDING CHAPTER 27, ARTICLE I, DIVISION 5, "LICENSES," OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), TO INCORPORATE CHAPTER 62 330 AND THE RELEVANT PORTIONS OF CHAPTER 40E OF THE FLORIDA ADMINISTRATIVE CODE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners at its meeting of April 22, 2014.
What Action Accomplishes
Amends the Code to incorporate Chapter 62-330, Florida Administrative Code, and the relevant portions of Chapter 40E of the Florida Administrative Code.

Summary Explanation/Background
At the Commission meeting of January 28, 2014, the Board of County Commissioners directed the Office of the County Attorney to prepare an Ordinance to amend Chapter 27 of the Broward County Code of Ordinances, relating to licenses obtained from the Environmental Protection Growth Management Department ("EPGMD"), Environmental Licensing and Building Permitting Division. In accordance with Subsection 373.4131(2)(b)1., Florida Statutes, any State of Florida program delegated to EPGMD that is governed by the provisions of the Florida Administrative Code and Florida Statutes will also be governed by Chapters 62-330, 40E-0, 40E-1, 40E-4, and 40E-41, Florida Administrative Code, along with the associated Applicant's Handbook Volumes I and II. The proposed Ordinance amends Section 27-52 of the Code to incorporate the foregoing provisions.
