MOTION TO APPROVE settlement of Claim 0533 and to authorize County Administration and the Office of the County Attorney to execute applicable settlement documents.

ACTION:  (T-10:22 AM)  Approved.
 
VOTE: 8-0.  Commissioner Jacobs was not present.

In accordance with the Code of Ordinances of Broward County, Florida, Section 1-51.3(E)(2), settlements exceeding the amount of $15,000 require prior Board approval.

The claim will be a final settlement, so no further claims can be advanced on this matter.

THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On March 7, 1996, the Claimant, a Bus Operator, sustained an injury while in the course and scope of employment with the Broward County Transit Division. The Claimant has been treated for this injury which has been accepted as compensable. The Claimant is no longer employed by Broward County as of January 11, 2013.

Through negotiations conducted with the Claimant, a proposed settlement has been reached in the total amount of $777,237, which includes: settlement of indemnity and medical benefits in the amount of $700,852, attorney fees of $75,885, and a Release and Resignation Agreement of $500.

Please note the Concurrence Memorandum was signed by the Office of the County Attorney on April 4, 2014, which is within the 90-day period requested by the Board.
