ACTION:  (T-10:34 AM)  Approved.  The Board requested that funds be retained in the Safe Parks and Land Preservation Program for the potential of an acquisition of another park.  (Refer to minutes for full discussion.)

VOTE:  8-0.  Commissioner Kiar was not present during the vote.

ACTION:  (T-10:41 AM)  Commissioner Kiar requested being shown voting the affirmative.

VOTE:  9-0.

Summary Explanation/ Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT AND NATURAL RESOURCES PLANNING AND MANAGEMENT DIVISION REQUEST APPROVAL OF THIS ITEM.

This item supports the Board’s vision of a pristine, healthy environment, Goal 2; encourage and promote community stewardship of the environment and an ethic of conservation.

On October 14, 2008, Broward County and the City of Fort Lauderdale entered into an Interlocal Agreement for the Acquisition, Improvement, Enhancement, Operation and Management of Open Space Site OS-145 Middle River Terrace Park Addition located at 1325 NW 7 Avenue. At that time, the City had a purchase contract with the property owner. Over the intervening five years, environmental site assessments revealed the presence of arsenic contamination in the soils and groundwater of the property; the owner defaulted on the property; and the appraised value of the property greatly diminished. As a result, the City has agreed to the Mutual Termination of Agreement for this property (see Exhibit 1).

There are $929,500 of Land Preservation Bond funds allocated to the Middle River Terrace Addition. Upon approval of this item, the funds will be retained to offset administrative fees that have resulted from the continuation of the Land Preservation Program beyond it originally intended timeframe.
