THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The 15-foot-wide portion of a platted utility easement to be vacated measures approximately 22,275 square feet, lying over, across, through and under Parcel A of the P & J Estates Plat, as recorded in Plat Book 161, Page 23 of the Public Records of Broward County and is located on Camelot Circle and SW 105 Avenue in the Town of Davie, in Section 30, Township 50 South, Range 41 East. The folio numbers affected by the proposed vacation are 5041-30-08-0100, 5041-30-08-0110, 5041-30-08-0120, 5041-30-08-0130, 5041-30-08-0140, 5041-30-08-0150, 5041-30-08-0160, and 5041-30-08-0200.
Vacation of the subject platted utility easement cited above will provide clear unencumbered title to the affected area of the land to the property owner Lowell at Camelot, Inc.
The Town of Davie approved this vacation by adopting Resolution No. R-2013-186 on September 18, 2013.
Petitioner published a Notice of Intent to vacate on October 2, 2013 and October 9, 2013.
The vacation application and fee were received and the fee was deposited by the County's Real Property Section on February 20, 2014.
Review of this application by the County Attorney’s Office, applicable County agencies, and utility companies was completed on April 1, 2014. No reviewing agency has indicated that the easement to be vacated is currently used, nor is there a plan for future use. No objections to this vacation were raised by any of the reviewing agencies.
