MOTION TO APPROVE Sixth Amendment to Lease Agreement between Broward County as Tenant and the City of Lauderhill as Landlord for the sublease of the library premises located at the Lauderhill Mall, 4257 NW 12 Street in Lauderhill, Florida; extending the lease term for an additional one year commencing October 1, 2014 and terminating on September 30, 2015 and granting the County the unilateral right to terminate the lease with 30 days prior written notice; and authorize the Mayor and Clerk to execute same. (Commission District 9)

Why Action is Necessary
Board of County Commissioners' approval is required to amend a lease pursuant to Broward County Administrative Code, Section 6.23.
What Action Accomplishes
Provides for the Lauderhill Mall Branch Library to remain at its current location until construction is complete on the new Lauderhill Branch Library at the Central Broward Regional Park located at 3700 NW 11 Place in Lauderhill.

Summary Explanation/ Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND THE LIBRARIES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

The Lauderhill Branch Library has operated at the Lauderhill Mall since 1986 under a sublease agreement with the City of Lauderhill. On March 24, 1987, Item No. 48, the Board of County Commissioners approved a lease for a term of one year commencing on October 1, 1986 and terminating September 30, 1987. Subsequently, the lease has been extended through amendments, the most recent being the Fifth Amendment approved by the Board of County Commissioners on June 7, 2011, Item No. 22, which extended the term through September 30, 2014. This Sixth Amendment will provide for a one year lease extension commencing on October 1, 2014 and terminating on September 30, 2015. The County will also have the unilateral right to terminate at any time with 30 days prior written notice to the City. Accordingly, the library will remain operational at its current location until such time as the new Lauderhill Branch Library, which is part of the Cultural Arts Center at Central Broward Regional Park, is completed by the City of Lauderhill. While the new library is scheduled to be completed in August of 2014, given the possibility of construction delays and the subsequent time required to relocate into the new library, approval of this Sixth Amendment is recommended. Pursuant to the lease, the County pays no rent for the premises.
