Board of County Commissioners' approval is required to vacate a platted utility easement pursuant to Broward County Administrative Code, Section 25.99.

Summary Explanation/ Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The 12-foot-wide platted utility easement to be vacated measures approximately 1,128 square feet, lying over, across through and under Lots 1 and 2, Block 21 of the Pompano Estates Third Addition Plat, as recorded in Plat Book 58, Page 30 of the Public Records of Broward County and is located at 3100 NE First Avenue, in the City of Pompano Beach, in Section 23, Township 48 South, Range 42 East. The folio number affected by the proposed vacation is 4842-23-09-0100.

The utility easement to be vacated cited above will provide clear unencumbered title to the affected area of the land to the property owner Darco Two, LLC.

The City of Pompano Beach approved this vacation by adopting Ordinance No. 2014-06 on November 12, 2013.

Petitioner published a Notice of Intent to vacate on November 21, 2013 and November 28, 2013.

The vacation application and fee were received and the fee was deposited by the County's Real Property Section on December 19, 2013.

Review of this application by the County Attorney’s Office, applicable County agencies, and utility companies was completed on March 19, 2014. No reviewing agency has indicated that the easement to be vacated is currently used, nor is there a plan for future use. No objections to this vacation were raised by any of the reviewing agencies.

Revenue was collected and deposited in the amount of $1,200 as a vacation application fee.
