MOTION TO ADOPT Resolution No. 2014-262 approving and authorizing the conveyance of certain real property to the City of Plantation by Quit Claim Deed a vacant parcel of land adjacent to 7351 NW 5 Street in Plantation for nominal consideration pursuant to Florida Statutes, Section 125.38 determining the property is not needed for County purposes; and authorize the Mayor and Clerk to execute the quit claim deed; and authorize recordation of same. (Commission District 1)

Summary Explanation/ Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

This parcel identified by folio number 5041-03-02-0050 is located adjacent to the Liberty Tree Park located at 7351 NW 5 Street in the City of Plantation. The parcel measures 59 feet wide by 500 feet long and contains 29,500 square feet. City zoning is B-6P (Institutional-Educational) and the land use plan is Recreation and Open Space.

The County acquired the property in August 1964 via a warranty deed from Frederick C. Peters and Berenice T. Peters as recorded in Official Records Book 2854, Page 24 of the Public Records of Broward County. In November 1964, the area surrounding this parcel was annexed into the City of Plantation via City Resolution 357. However, the Resolution inadvertently omitted the subject property from the transfer. The City has been maintaining this area and incorporated the parcel into the City's Liberty Tree Park. In an effort to establish clear title, the subject property should be conveyed to the City. On January 8, 2014, the City Council of the City of Plantation passed City Resolution 11823, accepting the conveyance.
