Requested Action
MOTION TO ADOPT Resolution No. 2014-250 directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, May 13, 2014, at 2:00 p.m., and Tuesday, June 10, 2014, at 2:00 p.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY ZONING CODE; AMENDING VARIOUS SECTIONS OF CHAPTER 39 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), TO DEFINE AND PROVIDE FOR THE PLACEMENT AND REGULATION OF DONATION BINS AND CLOTHING DONATION BINS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meeting of February 11, 2014.

Summary Explanation/ Background
Sections 39-300 and 39-313 of the Zoning Code currently provide for mobile collection centers as a permitted use in some commercial and industrial zoning categories subject to separation and trailer size requirements. A "mobile collection center" is defined by the Zoning Code as a trailer or mechanical depository used for the collection and temporary storage of aluminum cans or other aluminum products, paper, or clothing material. The Zoning Code does not address smaller donation bins which are often utilized for the donation of clothing.

The proposed Ordinance would amend the Zoning Code to provide for clothing donation bins as a permitted use in commercial, industrial, and community facilities zoning categories and for the regulation of clothing donation bins through a permitting process, including location and separation criteria, installation requirements, and maintenance requirements for the donation bins and their surrounding area.
