Broward County Commission Public Hearing

MOTION TO ADOPT Resolution No. 2014-260 to amend the Administrative Rules Document: Broward County Land Use Plan to create a new Article 10 entitled "Rules for Implementation and Administration of Broward County Land Use Plan Policy 1.07.07," the substance of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, RELATING TO AFFORDABLE HOUSING POLICIES; APPROVING AND ADOPTING CHANGES TO THE ADMINISTRATIVE RULES DOCUMENT: BROWARD COUNTY LAND USE PLAN ("ADMINISTRATIVE RULES DOCUMENT"), CREATING A NEW ARTICLE 10 TO BE ENTITLED "RULES FOR IMPLEMENTATION AND ADMINISTRATION OF BROWARD COUNTY LAND USE PLAN POLICY 1.07.07," PROVIDING FOR INTENT, DESCRIPTION OF TERMS, AND COUNTY STAFF GUIDELINES AND REVIEW PROCEDURES FOR LAND USE PLAN AMENDMENTS SUBJECT TO POLICY 1.07.07; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE RULES DOCUMENT, AND AN EFFECTIVE DATE.

VOTE:  6-0.  Mayor Jacobs was not present.  Commissioner LaMarca and Mayor Sharief were not present at the time of the vote.

Certain amendments to the Administrative Rules Document: Broward County Land Use Plan require a public hearing by the Board of County Commissioners, with proper notice.

The Resolution amends the Administrative Rules Document: Broward County Land Use Plan to create a new Article 10 relating to affordable housing policies.

April 8, 2014 - Set the public hearing for April 22, 2014.

At its March 27, 2014, meeting, the Broward County Planning Council considered the subject agenda item and recommended approval of an amendment to the Administrative Rules Document: Broward County Land Use Plan to create a new Article 10 relating to affordable housing Policy 1.07.07, with the additional recommendation that "Option 2" be utilized for the in-lieu of fee payment of $1 per gross square foot of floor area per residential dwelling unit. See Attachment 20, Exhibit 2 (The payment in-lieu of approach is not a requirement and is available as an alternative if a municipality is determined not to meet the Policy, as outlined in Article 10).
