Board of County Commissioners' approval is required to adopt a Resolution accepting a deed conveying real property to Broward County pursuant to Broward County Administrative Code, Section 6.23.

Summary Explanation/ Background
THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION/REAL PROPERTY SECTION AND HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

Genesis RE Holdings, LLC (GENESIS) owns certain property located at 10030 NW 37 Street in Cooper City identified by folio number 5141-05-01-0192 (Property). The legal description of the Property includes a portion of North Palm Avenue right-of-way measuring 100 feet wide (Road ROW).

The relevant portions of the Property's title history are as follows: In 1991, the previous owners of the Property, the Abdools, acquired the Property (including the Road ROW) via Warranty Deed recorded in Official Record Book 18761, Page 79 of the Public Records of Broward County. In 1996, the Abdools conveyed the Property (including the Road ROW) to the Williams via Warranty Deed as recorded in Official Records Book 25392, Page 153 of the Official Records of Broward County. In 1997, the Abdools conveyed only the Road ROW to the County via Quit Claim Deed as recorded in Official Records Book 29022, Page 1282 of the Public Records of Broward County thereby creating a cloud upon the title. Subsequently, the Property went into foreclosure, and in 2013 a Certificate of Title for the Property (including the Road ROW) was issued to Genesis, the current owner, as recorded in Official Records Book 50207, Page 1020 of the Public Records of Broward County. Genesis desires to clear the cloud on the title of the Property by conveying the Road ROW to Broward County via Quit Claim Deed and the County desires to accept the Quit Claim Deed.
