Summary Explanation/ Background
PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES RECOMMENDS APPROVAL

The Public Works Department and the Small Business Development Division established a Community Disadvantaged Business Enterprise (CDBE) goal of 20% for this project. Bergeron Emergency Services, Inc. committed to 24% CDBE participation. The goal was updated in 2010 to reflect the County Business Enterprise (CBE) program. No work has been performed under this contract. 

On August 25, 2009, Item 59, the Board of County Commissioners approved an agreement with Bergeron Emergency Services, Inc. (Bergeron) for disaster debris management services, with the condition that the County Attorney address items noted by the Board and report on the outcome of staff’s efforts. These items formed the basis of the First Amendment to the agreement, which was executed by the Mayor on May 26, 2010. The amendment revised the scope of services and the price sheet, and updated the goal language as stated above.

The agreement designates Bergeron as the primary contractor for immediate mobilization following a hurricane or other debris-producing event, including opening and operating temporary debris management sites. The agreement term is three years with two one-year renewals, and is set to expire on August 25, 2014.

The proposed Second Amendment would extend the Bergeron contract for approximately three additional months to November 30, 2014, in order to avoid changing contractors during this coming hurricane season. Solid Waste and Recycling Services is in the process of competitively soliciting for a replacement contract that will become effective concurrent with the end of hurricane season.

Under a separate motion to the August 25, 2009 agenda item that originally approved the Bergeron agreement, the Director of Purchasing was authorized to approve and execute agreements with up to three additional, qualified firms for use by the County on an as-needed basis. These firms have been provided with the same opportunity for contract extension through the end of the 2014 hurricane season. Two of the firms, Ashbritt, Inc. and DRC Emergency Services, LLC., opted to take advantage of this opportunity; the third firm, Storm Reconstructive Services, Inc., declined. Because the term extension will not take these contracts beyond a five-year term total, the Director of Purchasing has the authority to approve the extensions.

This amendment has been approved as to legal form by the County Attorney.

Fiscal Impact
Fiscal Impact/Cost Summary:
There are no changes in the agreement’s current rates for services. Because the cost of disaster debris management services is unique to each event, exact needs and costs cannot be determined in advance. Therefore, work authorizations will reflect budget/accounting actions that establish not-to-exceed limits for the specified tasks. Debris management services are reimbursed to the extent allowed by the Federal Emergency Management Agency following a declared emergency.
