The mortgage to Broward County was executed on September 24, 1997, and recorded in Official Records Book 17802, pages 0297 - 0300 in Miami-Dade County, Florida, by Alvaro Gomez and Mariana Gomez, for the purpose of posting a $250,000 appearance bond in the case of State of Florida v. Alvaro Gomez, Seventeenth Judicial Circuit Case No. 97-16715CF10A.
The full amount of this mortgage would become due and payable upon the failure of the defendant to comply with any order or condition of the Court. Broward County is required to satisfy this mortgage upon subsequent court order instructing Broward County to do so. On May 5, 1999, the court entered an Agreed Order on Stipulated Motion for Exoneration of Bond, thereby requiring the mortgage be satisfied.
Broward County is no longer involved with appearance bonds due to an amendment to Florida law shifting the responsibility to the State of Florida. |
