MOTION TO ADOPT Resolution No. 2014-223 directing the County Administrator to publish notice of a public hearing to be held on April 22, 2014, at 2:00 P.M., to consider approval of a Resolution approving and adopting changes to the Administrative Rules Document: Broward County Land Use Plan, creating a new Article 10 entitled "Rules for Implementation and Administration of Broward County Land Use Plan Policy 1.07.07," providing for intent, description of terms and county staff guidelines and review procedures for land use plan amendments subject to Policy 1.07.07; and providing for severability, inclusion in the Administrative Rules Document, and an effective date.

Should state: Adopting a Resolution.)  (Per the Tuesday Morning Memorandum, please be advised that in addition to the policy language regarding standardizing the local government studies for affordable housing, the Planning Council also adopted a standard "payment in lieu of" policy.  This policy establishes a cost of $1 per square foot for the gross floor area for the proposed development.  The "payment in lieu of" approach is available to the cities as an alternative for the mitigation options identified in Policy 1.07.07.  This is not a requirement, but an alternative for the cities consideration.  This can be found on Pages 5 and 6 of Exhibit A to the Resolution (option 2); option 1 was not approved.)

It is necessary to schedule a public hearing of the Broward County Board of County Commissioners to be held subsequent to receipt of a recommendation from the Broward County Planning Council prior to adoption of appropriate portions of the Administrative Rules Document.

The Resolution directs the County Administrator to set a public hearing for April 22, 2014, to consider creating a new Article 10 entitled "Rules for Implementation and Administration of Broward County Land Use Plan Policy 1.07.07."

The Broward County Commission initiated this amendment to the Administrative Rules Document on November 12, 2013. 

The Planning Council, as the Local Planning Agency (LPA) responsible for the Broward County Land Use Plan, considered the following proposal at its January 23, 2014, February 27, 2014, and March 27, 2014, public hearings. Further, multiple workshops among appointees of the Broward County Planning Council,  Broward County Commission and Broward League of Cities were held, as well as a staff level workshop. 

The proposal creates a new Article 10 entitled "Rules for Implementation and Administration of Broward County Land Use Plan Policy 1.07.07," providing for intent, description of terms and county staff guidelines and review procedures for land use plan amendments subject to Policy 1.07.07.
