MOTION TO APPROVE settlement of Claim 061907 and to authorize County Administration and the Office of the County Attorney to execute applicable settlement documents.

ACTION: (T-10:17 AM) Approved.

VOTE: 8-0. Commissioner Kiar was not present.

In accordance with the Code of Ordinances of Broward County, Florida, Section 1-51.3(E)(2), settlements exceeding the amount of $15,000 require prior Board approval.

The claim will be a final settlement, so no further claims can be advanced on this matter.

THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On June 19, 2007, the Claimant, a Warehouse Worker, sustained injuries while in the course and scope of employment with the Broward County Supervisor of Elections. The Claimant was treated for these injuries which have been accepted as compensable.

Through negotiations conducted with the Claimant, a settlement was reached in the total amount of $162,500. Of this amount, counsel for the Claimant will receive $60,500 for attorney's fees and costs. This settlement proposal includes a settlement of all future indemnity and medical benefits. The Claimant will net $101,500, plus $500 for a Release and Resignation Agreement.

Please note the Concurrence Memorandum was signed by the Office of the County Attorney on March 11, 2014, which is within the 90-day period requested by the Board.
