Requested Action

MOTION TO ADOPT Resolution No. 2014-210 authorizing the Mayor and Clerk to execute the Florida Department of Transportation, Supplemental Joint Participation Agreement No. 8 to Grant No. 407704-1-94-01 as set forth in EXHIBIT “F” of Supplemental Joint Participation Agreement No. 8; and to authorize the County Administrator to make the necessary administrative and budgetary actions to execute the grant agreement and approve any non-monetary amendments to the agreement. This agreement requires a County match of $128,948,115.

Summary Explanation/ Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

This item supports the Board's Vision for "Unlimited Economic Opportunities," its Goal to "increase the economic strength and impact of Port Everglades, the Broward County Convention Center and the Fort Lauderdale-Hollywood International Airport (FLL) in a sustainable manner balancing economy, environment and community," and its Objective to increase runway capacity through construction of one new 8,000-foot runway at FLL.

This action will allow Broward County (County) to accept quarterly reimbursement payments from the Florida Department of Transportation (FDOT) Grant No. 407704-1-94-01 during the State’s fiscal years 2016, 2017, and 2018 as set forth in Exhibit “F” in Supplemental Joint Participation Agreement (SJPA) No. 8.

On June 10, 2008 (Item No. 2), the Board authorized execution of a Joint Participation Agreement (JPA) between the County and FDOT for Financial Project No. 407704-1-94-01 in the amount of $50,120,607, to participate financially with the County in a project to extend the South Runway at FLL. At that time, FDOT notified the County that the grant funding would be distributed over a multi-year period with the availability of funds subject to Legislative appropriation.

On March 24, 2009 (Item No. 4), the Board authorized execution of an SJPA adding an additional $15,282,000 to the original JPA, for a total of $65,402,607.

On May 5, 2009 (Item No. 2), the Board authorized execution of SJPA No. 2 reducing the amount of the previous SJPA by ($1,500,000), for a total of $63,902,607.

On January 26, 2010 (Item No. 2), the Board authorized the execution of SJPA No. 3 adding an additional $8,600,000, to the previous SJPA for a total of $72,502,607.

On August 10, 2010 (Item No. 2), the Board authorized the execution of SJPA No. 4 reducing the amount of the previous JPA by ($777,069), for a total of $71,725,538.

On May 10, 2011 (Item No. 2), the Board authorized the execution of SJPA No. 5 adding an additional $27,149,719, to the previous SJPA for a total of $98,875,257.

On January 10, 2012 (Item No. 2), the Board authorized the execution of SJPA No. 6 adding an additional $24,010,038, to the previous SJPA for a total of $122,885,295. This SJPA No. 6 also increased the term of the Grant for an additional year to 2017 allowing FDOT to continue to participate financially with the County in the South Runway Expansion project.

On August 13, 2013 (Item No. 2), the Board authorized the execution of SJPA No. 7 adding an additional $6,062,820 to the previous SJPA for a total of $128,948,115 and increasing the term of the Grant for an additional year to 2018.

Approval of the execution of SJPA No. 8 will enable FDOT to reimburse Broward County according to Exhibit “F” “Schedule of Deferred Reimbursement Payments”, (Exhibit 2).

This SJPA has been reviewed by the Office of the County Attorney and approved as to form. However, this SJPA does not include the County's standard agreement provisions because FDOT requires the County to use its form agreement.

Fiscal Impact/Cost Summary:
This project is budgeted in the Aviation Department’s Expansion of Runway 9R/27L and Enabling Projects Fund (4400), and is funded in its entirety through a variety of sources, including but not limited to: FAA Federal Airport Improvement Program Grants, FDOT Grants, and Airport PFC Backed Revenue Bonds.
