Requested Action
A. MOTION TO APPROVE Revocable License Agreement  between Broward County and the Broward Sheriff's Office,  to use Broward County Transit’s bus facilities for the purpose of conducting law enforcement functional drills and exercises; and authorize the County Administrator to execute same and to take all necessary administrative actions to implement the agreement. The term of this agreement is effective upon execution for a term of two years, with three one-year optional renewals. (Commission Districts 2 and 7)

B. MOTION TO APPROVE Standard Form Revocable License Agreement between Broward County and various municipalities or entities, on behalf of their police departments, to use Broward County Transit’s bus facilities for the purpose of conducting law enforcement functional drills and exercises; and authorize the County Administrator to execute same and to take all necessary administrative actions to implement the agreements. The term of the agreements are effective upon execution for a term of two years, with three one-year optional renewals. (Commission Districts 2 and 7)

Why Action is Necessary
Board approval is necessary to enter into interlocal agreements with other governmental entities.

Summary Explanation/Background
THE TRANSPORTATION DEPARTMENT AND TRANSIT DIVISION RECOMMEND APPROVAL

The Broward County Transit Division (BCT) receives requests from the Broward Sheriff's Office and various law enforcement agencies to use the bus yards located at 3201 West Copans Road, in the City of Pompano Beach, and 5440 Ravenswood Road, in the City of Dania Beach for law enforcement training exercises. Under the terms of this standard form Revocable License Agreement, participating entities (on behalf of their police departments/agencies) will enter into an agreement with Broward County for the use of BCT’s bus yard(s) for these exercises. The term of the agreements to be executed by the County Administrator are for two years with three one-year optional renewals.

Through this standard form agreement, the law enforcement entities shall use and occupy the bus yards (i.e., licensed premises) only for the purpose of conducting law enforcement functional drills and exercises, including, but not limited to, driver training, SWAT training with various buses, and bomb threat responses. The licensed premises shall not be used for any other purpose whatsoever without prior written consent of the County.

The County Attorney’s Office developed and approved this standard form agreement with input from BCT and the Risk Management Division.
