MOTION TO APPROVE settlement of Claim 0920103173 and to authorize County Administration and the Office of the County Attorney to prepare applicable settlement documents.

ACTION:  (T-10:26 AM)  Approved.

VOTE:  8-0.  Vice Mayor Furr was not present.

The amount of the proposed settlement requires Board approval.

The claim will be a final settlement, so no further claims can be advanced on this matter, and the case will be closed.

THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RISK MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On September 20, 2010, the claimant, a forensic technician with the Broward County Medical Examiners’ Office, sustained injury to the lower back during a work-related accident. The claimant received extended conservative treatment. The claimant reached maximum medical improvement on September 20, 2013, with a 3% impairment rating.

Through negotiations with the claimant, a settlement was reached in the total amount of $20,000. This amount is broken down as follows: (1) the claimant will receive $12,000, plus $500 for a Release and Resignation Agreement; and (2) the claimant’s attorney will receive $7,200 for fees and $300 for costs. The settlement includes all future indemnity and medical benefits. The settlement is conditioned on a release of the County from any further obligations.

Please note the Concurrence Memorandum was signed by the Office of the County Attorney on January 9, 2017, which is within the 90-day period requested by the Board.
