MOTION TO ADOPT Resolution No. 2017-027 of the Board of County Commissioners of Broward County, Florida, the title of which is as follows:

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT; AMENDING SECTIONS 2.11, 40.13, AND VARIOUS PROVISIONS IN CHAPTERS 8 AND 27 OF THE BROWARD COUNTY ADMINISTRATIVE CODE ("ADMINISTRATIVE CODE"), TO REFLECT CHANGES IN DIVISION NAMES AND ORGANIZATIONAL STRUCTURE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Section 3.04(A) of the Broward County Charter requires a public hearing to be held concerning the adoption of proposed amendments to the Broward County Administrative Code.

Summary Explanation/Background
THE ENVIRONMENTAL PROTECTION AND GROWTH MANAGEMENT DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The purpose of this agenda item is to codify various organizational and name changes along with appropriate adjustments to functions and responsibilities necessary to re-establish building code services as a separate Building Code Services Division within the Environmental Protection and Growth Management Department. Building code functions were previously merged with environmental licensing and consumer protection tasks into the Environmental Licensing and Building Permitting Division in response to declines in construction activity. However, the emergence of FLL as the fourth fastest growing airport in the country necessitates organizational enhancements to accommodate construction demand. In addition, Broward County has also increased building code services to municipalities on a cost-recovery basis. Currently, Broward County has agreements with 23 municipalities for building code services.

Complementary to the reorganization establishing a new Building Code Services Division, the current Environmental Licensing and Building Permitting Division and current Pollution Prevention Division will be reorganized into a new Environmental Engineering and Permitting Division and a new Environmental and Consumer Protection Division, with appropriate adjustments to functions and responsibilities, as follows:
  1. Changing the name of the Environmental Licensing and Building Permitting Division (ELBPD) to the Environmental Engineering and Permitting Division (EEPD); incorporating existing functions and responsibilities for the environmental assessment and remediation program, air quality licensing and compliance program and air quality planning and monitoring program; and deleting certain responsibilities for enforcement actions, public records requests, consumer protection and licensing that will be transferred to the new Environmental and Consumer Protection Division (described below); consistent with Board approval of the creation of new job classifications, title changes and Board-level reclassifications to facilitate organizational and name changes within the Environmental Protection and Growth Management Department.
  2. Changing the name of the Pollution Prevention Division to the Environmental and Consumer Protection Division (ECPD); incorporating certain existing responsibilities for enforcement actions, public records requests, consumer protection and licensing that will be transferred from ELBPD; deleting certain responsibilities for the environmental assessment and remediation program, air quality licensing and compliance program and the air quality planning and monitoring program that will be transferred to EEPD; consistent with Board approval of the creation of new job classifications, title changes and Board-level reclassifications to facilitate organizational and name changes within the Environmental Protection and Growth Management Department.
These actions do not add new positions to the personnel cap and can be accommodated within the Fiscal Year 2017 adopted Department budget.

This agenda item also proposes to update the existing fee schedules to reflect the new BCSD.
