A. MOTION TO APPROVE shell agreement between Broward County and County utility customers in the Broward Municipal Services District in accordance with the Broward County Connection Incentive Program. (Commission Districts 2 and 7)

VOTE:  8-0.  Vice Mayor Furr was not present.

B. MOTION TO AUTHORIZE County Administrator or authorized designee to execute the individual shell agreements with County utility customers in the Broward Municipal Services District in accordance with the Broward County Connection Incentive Program. (Commission Districts 2 and 7)

ACTION:  (T-10:26 AM)  Approved.

VOTE:  8-0.  Vice Mayor Furr was not present.

Motion A: Board of County Commissioners’ approval is required for all shell agreements.  

Motion B: Board of County Commissioners’ approval is required to authorize the County Administrator or authorized designee to execute the shell agreements with the individual property owners.

Motion A: Provides approval of the shell agreement form for use in the Broward County Connection Incentive Program.

Motion B: Enables the County Administrator or authorized designee to execute the Connection Incentive Program agreement with Broward Municipal Services District property owners who elect to participate in this program.

PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES DIVISION RECOMMENDS APPROVAL

MOTION A - On August 16, 2016 (Item No. 91), the Board of County Commissioners authorized the County Administrator to develop a  Broward County Water and Wastewater Services Connection Incentive Program for County utility customers in the Broward Municipal Services District to facilitate and expedite the connection of properties to new water and/or sewer systems.

As part of the development of this program, staff and the County Attorney's Office prepared the Connection Incentive Program shell agreement (Exhibit 1) to be executed by property owners who opt into the program. The County would contract for the installation of the connection infrastructure for participating properties. Opting into this program allows the property owner to either finance the cost of this work through Water and Wastewater Services at no interest over a period of 180 months, or pay for the work in full within 60 calendar days of receipt of the bill for the connection service. If a property owner does not opt into the program, they will be responsible for providing the connection of the water and sewer services and all associated costs. Liens would be recorded for each property participating and would be satisfied upon full repayment.

Hillsboro Pines properties will be the first Broward Municipal Services District neighborhood to participate in this program. Commission Districts 2 and 7 are the only areas with both Broward County utility service in the BMSD.

MOTION B - Staff is recommending that the County Administrator or their authorized designee be granted the authority to execute these agreements as they are received from the residents.
